The Disability Rights Commission is actively seeking to clarify legal and implementational matters relating to web site accessibility.
Following a Formal Investigation, the DRC findings (PDF) revealed that Most websites (81%) fail to satisfy the most basic Web Accessibility Initiative category
and amongst developers, only 9% claimed any sort of expertise
, citing problems with the cost in time and resources, lack of knowledge, the lack of authoritative guidance, and conflict with aesthetic and other design considerations

This points the finger squarely at web design agencies as a whole.
